Assault charges filed against Wilber Garcés Pérez, the Venezuelan man shot by ICE in Austin, Texas

(LPL/CNN) – Federal prosecutors in Texas have announced assault charges against a Venezuelan delivery driver who was shot in the back by immigration agents on September 20.

A federal complaint alleges that Wilber Rafael Garcés Pérez, 28, attempted to flee from U.S. Immigration and Customs Enforcement (ICE) agents, who had ordered him to stop after a judge issued a final removal order, according to Justin R. Simmons, U.S. Attorney for the Western District of Texas.

The complaint accuses him of striking an agent with the driver’s side-view mirror and subsequently attempting to run over an agent with his vehicle. If convicted, Garcés Pérez could face up to 20 years in prison.

Garcés Pérez reportedly handed over his driver’s license but ignored the agents’ requests to exit the vehicle. He allegedly spoke in Spanish with one of the federal agents about moving and parking the vehicle, and court documents note that «the tone of the conversation was cordial and not aggressive.»
Court documents further allege that, about a minute later, Garcés Pérez «abruptly» closed the window and drove away. One of the agents, L.G., was struck in the torso by the driver’s side-view mirror.

Garcés Pérez entered the U.S. in 2024 via CBP One, a program launched during President Joe Biden’s administration that allowed migrants to schedule appointments with U.S. authorities to have their asylum claims evaluated. President Donald Trump ended that program on his first day in office.

Garcés Pérez was an asylum seeker and held a valid work permit, according to immigration attorney Kate Lincoln-Goldfinch. The lawyer stated that a judge issued a deportation order after Garcés Pérez missed an immigration court hearing because the notice had been sent to a previous address.
