(LPL) – Marco Izaguirre, padre del exagente del condado de Shelby Michael Yzaguirre que está acusado de tener relaciones sexuales con una mujer en estado de ebriedad, emitió una declaración pública en respuesta a las acusaciones penales que enfrenta su hijo. En un mensaje publicado en Facebook, expresó su postura sobre la situación y subrayó la importancia de la responsabilidad personal y la igualdad ante la ley.

“A la luz de los acontecimientos recientes, creo que debo abordar algunas preguntas y comentarios que he recibido, pero quiero ser claro. Esta será mi única declaración sobre la situación. Como padre amoroso, me importa profundamente el bienestar de mi familia y las lecciones que aprendemos en la vida. Es importante reconocer que, como adultos, tenemos la responsabilidad exclusiva de tomar nuestras propias decisiones, y a veces esas elecciones pueden conducir a consecuencias negativas. Creo firmemente que la ley debe aplicarse por igual a todos, independientemente de su estatus o antecedentes. La rendición de cuentas es crucial para fomentar una sociedad justa, y todos debemos esforzarnos por adherirnos a los principios de esa justicia,” indicó el oficial Marco, quien es supervisor de la oficina del sheriff y es está postulando para sheriff del condado de Shelby.

Según los registros de SCSO, el 9 de junio de 2024, Michael Yzaguirre, quien se encontraba fuera de servicio, y el entonces agente en funciones Sheldon Smith, respondieron a un reporte sobre una mujer aparentemente ebria dentro de un vehículo dañado en Airline Road, cerca de Memphis-Arlington Road.

La mujer afirmó haber sido agredida por su esposo, pero los agentes no realizaron una prueba de sobriedad, no verificaron daños en la ruta ni investigaron las denuncias de violencia doméstica.

En lugar de seguir los procedimientos apropiados, Smith —según su carta de despido— apagó su cámara corporal y, junto con Yzaguirre, llevó a la mujer a un hotel. Luego, Yzaguirre mantuvo relaciones sexuales con ella, a pesar de que, según su propia admisión, la mujer no estaba en condiciones de dar su consentimiento debido al alto nivel de intoxicación. SCSO calificó el acto como una grave violación ética y profesional.

Yzaguirre fue despedido el 9 de agosto de 2024 tras una investigación interna.

Ambos exagentes inicialmente mintieron sobre el estado de la mujer, pero con el avance de la investigación, Yzaguirre terminó confesando lo ocurrido. También se descubrió que accedió de manera irregular al sistema W.A.S.P., una base de datos confidencial utilizada para consultar historiales criminales y datos personales, durante el proceso de investigación.

Yzaguirre y Smith deberán comparecer este jueves ante el Comité de Normas y Certificación de Oficiales de Paz (POST) en una audiencia informal. El comité decidirá si recomienda retirarle la certificación, lo que impediría a Yzaguirre volver a ejercer como agente del orden en Tennessee.

“In light of recent events I believe I need to address some questions and comments I have received but I want to be clear. This will be my only statement regarding the situation. As a loving father, I deeply care about my family’s well-being and the lessons we learn in life. It’s important to recognize that as grown adults, we have the sole responsibility to make our own decisions, and sometimes those choices can lead to negative consequences. I firmly believe that the law should apply equally to everyone, regardless of their status or background. Accountability is crucial in fostering a just society, and we must all strive to adhere to the principles of that”, said Officer Marco, who is a supervisor with the Sheriff’s Office and is running for Shelby County Sheriff.

According to SCSO records, on June 9, 2024, off-duty Michael Yzaguirre and then-acting Deputy Sheldon Smith responded to a report of an apparently intoxicated woman inside a damaged vehicle on Airline Road near Memphis-Arlington Road.

The woman claimed to have been assaulted by her husband, but the officers failed to perform a field sobriety test, inspect the road for damage, or investigate the allegations of domestic violence.

Instead of following proper procedures, Smith—according to his termination letter—turned off his body camera and, along with Yzaguirre, drove the woman to a hotel. Yzaguirre then had sex with her, despite the fact that, by his own admission, the woman was in no condition to consent due to her high level of intoxication. SCSO called the act a serious ethical and professional violation. Yzaguirre was terminated on August 9, 2024, following an internal investigation.

Both former officers initially lied about the woman’s condition, but as the investigation progressed, Yzaguirre eventually confessed to what had happened. He was also found to have improperly accessed the W.A.S.P. system, a confidential database used to look up criminal histories and personal data, during the investigation.

Yzaguirre and Smith are scheduled to appear before the Peace Officer Standards and Certification Committee (POST) this Thursday for an informal hearing. The committee will decide whether to recommend revoking Yzaguirre’s certification, which would prevent Yzaguirre from serving as a law enforcement officer in Tennessee.
