Hispanic Officer Could Lose Certification After Serious Off-Duty Misconduct

(LPL/FOX13) – El exagente hispano de la Oficina del Sheriff del Condado de Shelby (SCSO, por sus siglas en inglés), Michael Yzaguirre, enfrenta la posibilidad de perder su certificación como oficial de la ley en Tennessee, tras ser despedido por una grave violación del deber que involucró a una mujer en estado de ebriedad.

Según los registros de SCSO, el 9 de junio de 2024, Yzaguirre, quien se encontraba fuera de servicio, y el entonces agente en funciones Sheldon Smith, respondieron a un reporte sobre una mujer aparentemente ebria dentro de un vehículo dañado en Airline Road, cerca de Memphis-Arlington Road. La mujer afirmó haber sido agredida por su esposo, pero los agentes no realizaron una prueba de sobriedad, no verificaron daños en la ruta ni investigaron las denuncias de violencia doméstica.

En lugar de seguir los procedimientos apropiados, Smith —según su carta de despido— apagó su cámara corporal y, junto con Yzaguirre, llevó a la mujer a un hotel. Luego, Yzaguirre mantuvo relaciones sexuales con ella, a pesar de que, según su propia admisión, la mujer no estaba en condiciones de dar su consentimiento debido al alto nivel de intoxicación. SCSO calificó el acto como una grave violación ética y profesional. Yzaguirre fue despedido el 9 de agosto de 2024 tras una investigación interna.

Ambos exagentes inicialmente mintieron sobre el estado de la mujer, pero con el avance de la investigación, Yzaguirre terminó confesando lo ocurrido. También se descubrió que accedió de manera irregular al sistema W.A.S.P., una base de datos confidencial utilizada para consultar historiales criminales y datos personales, durante el proceso de investigación.

Yzaguirre y Smith deberán comparecer este jueves ante el Comité de Normas y Certificación de Oficiales de Paz (POST) en una audiencia informal. El comité decidirá si recomienda retirarle la certificación, lo que impediría a Yzaguirre volver a ejercer como agente del orden en Tennessee.

(LPL/FOX13) -Former Shelby County Sheriff’s Office (SCSO) deputy Michael Yzaguirre, a Hispanic officer, may lose his law enforcement certification in Tennessee after being terminated for serious misconduct involving an intoxicated woman.

According to SCSO records, on June 9, 2024, Yzaguirre—who was off duty at the time—and then-active deputy Sheldon Smith responded to a call about a woman slumped behind the wheel of a damaged vehicle on Airline Road near Memphis-Arlington Road. The woman told the deputies she had recently been assaulted by her husband. However, the deputies did not perform a sobriety test, check for damage along her driving route, or follow up on her domestic violence claims.

Instead, according to Smith’s termination letter, he turned off his body-worn camera and, along with Yzaguirre, took the woman to a hotel. Yzaguirre then had sex with her, later admitting she was too intoxicated to give full consent. SCSO described the act as a severe breach of ethical and professional conduct. Yzaguirre was terminated on August 9, 2024, following an internal investigation.

Both former deputies initially lied about the woman’s level of intoxication. SCSO reported that Yzaguirre even urged Smith to file a false report. As the investigation progressed, Yzaguirre ultimately confessed to what had occurred.

Termination records also show that Yzaguirre improperly accessed W.A.S.P., a confidential system used by SCSO deputies to retrieve criminal history, driver’s license data, photos, and warrant information, during the investigation.

Yzaguirre and Smith are scheduled to appear this Thursday before the Peace Officer Standards and Training (POST) Committee for an informal hearing. The committee will decide whether to move forward with decertification proceedings, which would prevent both former deputies from serving in law enforcement in Tennessee.
