Typically, for example, children in custody are not offered the option of voluntary departure, and those who request it must obtain approval from an immigration judge.

“Bringing children’s cases to immigration court when they choose voluntary departure is a protective mechanism,” said Shaina Aber, executive director of the Acacia Center for Justice, adding that an immigration judge is there to ensure the child understands what it means, that they are making the decision of their own free will, and that they are not put in danger.

There are just under 2,000 children in HHS custody, according to federal data. Most unaccompanied migrant children arriving at the US southern border come from Guatemala, Honduras, or El Salvador.

CNN contacted HHS and the Department of Homeland Security for comment. The Guatemalan embassy declined to comment.

Trump and his advisers have focused on migrant children released in the United States, arguing that they are in danger and that their whereabouts have not been accounted for, and criticizing the Biden administration’s handling of these children. Former Biden officials and several experts refute these claims.

The Trump administration has conducted welfare checks on migrant children residing in the country, established additional obstacles to children in custody being released to parents or relatives in the United States, subjected children to expedited immigration proceedings, begun interviewing them, and had federal agents ask certain children encountered in immigration enforcement operations if they wish to leave the country voluntarily, among other measures.
