Madre demanda a las Escuelas de Memphis-Shelby y al Departamento del Sheriff por presunta agresión a un niño de 7 años con discapacidad

(LPL) – Una madre de Memphis presentó una demanda federal contra Memphis-Shelby County Schools, el Departamento del Sheriff del Condado de Shelby y personal escolar, tras alegar que un oficial de recursos escolares (SRO) agredió a su hijo de 7 años en Levi Elementary.

Según la demanda, presentada el 21 de noviembre en la Corte Federal del Distrito Oeste de Tennessee, el incidente ocurrió el 22 de noviembre. El documento afirma que el niño, quien cuenta con un IEP y una discapacidad, fue arrojado contra una estantería, tirado al suelo, esposado y colocado en la parte trasera del vehículo del oficial. En la denuncia se menciona que la directora de la escuela y una maestra de educación especial estuvieron presentes. El SRO es identificado únicamente como “John Doe”.

La madre asegura que su hijo llegó a casa gritando y con un ojo morado, lo que la llevó a llamar al 911. El reporte también indica que el Departamento de Servicios para Niños fue notificado. La demanda alega violaciones de derechos civiles y discriminación por discapacidad, además de lesiones personales, incluyendo uso excesivo de fuerza, arresto falso, agresión, encarcelamiento injustificado, daño emocional intencional y negligencia.

La madre solicita medidas declaratorias, compensación económica, daños punitivos, costos legales y un juicio con jurado.

Sin embargo, el Departamento del Sheriff del Condado de Shelby respondió que no tenía oficiales asignados a Levi Elementary en ese momento ni actualmente, y calificó su inclusión en la demanda como un error. La oficina pidió que se desestime la acusación en su contra y exigió una disculpa del abogado de la parte demandante por haberlos nombrado incorrectamente.

Por su parte, Memphis-Shelby County Schools confirmó que está al tanto de la demanda, pero no realizará comentarios adicionales.

(LPL) – A Memphis mother has filed a federal lawsuit against Memphis-Shelby County Schools, the Shelby County Sheriff’s Department, and school personnel, alleging that a school resource officer (SRO) assaulted her 7-year-old son at Levi Elementary School.

According to the lawsuit, filed on November 21 in the U.S. District Court for the Western District of Tennessee, the incident occurred on November 22. The document states that the boy—who has an Individualized Education Program (IEP) and a disability—was thrown against a bookshelf, made to the ground, handcuffed, and placed in the back of the officer’s vehicle. The complaint mentions that the school principal and a special education teacher were present. The SRO is identified only as “John Doe.”

The mother says her son came home screaming and with a black eye, prompting her to call 911. The report also indicates that the Department of Children’s Services was notified. The lawsuit alleges civil rights violations and disability discrimination, as well as personal injuries, including excessive use of force, false arrest, assault, wrongful imprisonment, intentional emotional distress, and negligence.

The mother is seeking declaratory relief, monetary compensation, punitive damages, legal costs, and a jury trial.

However, the Shelby County Sheriff’s Department responded that it had no officers assigned to Levi Elementary at the time and currently does not, and called its inclusion in the lawsuit a mistake. The department requested that the charges against it be dismissed and demanded an apology from the plaintiff’s attorney for misnaming them.

Memphis-Shelby County Schools confirmed that it is aware of the lawsuit but declined to comment further.
