Governor Bill Lee questions new rules preventing immigrants from obtaining driver’s licenses in Tennessee

(LPL) – Tennessee Governor Bill Lee stated that he is seeking information regarding new state restrictions that have prevented immigrants—who hold federal authorization to live and work in the United States—from obtaining or renewing their driver’s licenses.

Lee made these remarks on Wednesday, October 28, after being asked by journalists about the situation facing hundreds of individuals who have been turned away at state offices, despite presenting valid work permits issued by the federal government.

According to the news outlet Tennessee Lookout, the governor indicated that he had only recently learned of the scope of the measure and that his administration is working to determine its consequences and whether any changes are necessary.

“We are trying to understand what the actual impact is and whether there are changes we need to make,” said Lee, who also raised the possibility that the interplay between state and federal laws might be resulting in unintended consequences.

The change affects, among other groups, beneficiaries of the Deferred Action for Childhood Arrivals (DACA) program, known as «Dreamers.» It is estimated that approximately 6,000 DACA recipients live in Tennessee. Asylum seekers and individuals with other immigration statuses—who possess federal authorization to work and reside in the country—could also be affected.

A change in accepted documentation

Until recently, employment authorization cards were accepted as sufficient proof for certain immigrants to apply for or renew a temporary Tennessee driver’s license. However, the state’s Department of Safety and Homeland Security has ceased recognizing them for this purpose.

A spokesperson for the agency explained that the decision stems from a provision in a state law passed in 2025, which has been in effect since January 1, 2026. The legislation stipulates that applicants must demonstrate that the federal government has authorized them to remain in the country for a specific period.

According to the department, a work permit alone does not provide sufficient information to verify that authorized period of stay. However, the law does not explicitly state that these documents must be excluded.

Attorneys and immigrant advocacy organizations question the state’s interpretation, warning that the new rules could leave thousands of people—who have lived and worked legally in Tennessee for years—without a driver’s license.

The consequences could be particularly severe for those who need to drive daily to get to work, take their children to school, or attend medical appointments. Furthermore, they could face fines, arrests, and potential immigration-related consequences if they drive without a license.

For the time being, the Department of Safety has not announced any changes to the requirements, as Governor Lee seeks to determine the full scope of the measure.
