Juez federal frena temporalmente la toma de control estatal de las Escuelas del Condado de Memphis-Shelby

(LPL) – Un juez federal suspendió temporalmente la toma de control de Memphis-Shelby County Schools (MSCS) por parte del estado de Tennessee, permitiendo que la junta escolar continúe administrando el distrito mientras avanza la demanda presentada contra la nueva ley estatal.

El juez Waverly Crenshaw Jr. emitió una orden de restricción temporal que impide, por ahora, que la junta de supervisión creada por el estado asuma las facultades que le otorgaba la legislación, incluyendo decisiones sobre contratos, compras y otras operaciones del distrito.

La demanda, presentada por el Gobierno del Condado de Shelby y la Junta Escolar de MSCS, sostiene que la ley es inconstitucional porque transfiere el control del distrito a una junta designada por el estado, restando autoridad a los funcionarios elegidos por los votantes.

Los demandantes también argumentaron que un cambio inmediato de administración podría afectar la preparación del próximo año escolar, retrasando contratos de transporte, mantenimiento y otros servicios esenciales.

La medida es temporal y permanecerá vigente mientras el tribunal analiza el caso y decide si el estado podrá asumir el control del distrito escolar más grande de Tennessee.

Federal judge temporarily halts state takeover of MSCS

(LPL) – A federal judge has temporarily blocked the state of Tennessee’s takeover of Memphis-Shelby County Schools (MSCS), allowing the school board to continue managing the district while the lawsuit challenging the new state law proceeds.

Judge Waverly Crenshaw Jr. issued a temporary restraining order preventing—for the time being—the state-created oversight board from assuming the powers granted by the legislation, including decision-making authority over contracts, procurement, and other district operations.

The lawsuit, filed by the Shelby County government and the MSCS school board, contends that the law is unconstitutional because it transfers control of the district to a state-appointed board, thereby stripping authority from officials elected by the voters.

The plaintiffs also argued that an immediate change in administration could disrupt preparations for the upcoming school year, delaying contracts for transportation, maintenance, and other essential services.

This measure is temporary and will remain in effect while the court reviews the case and decides whether the state may assume control of Tennessee’s largest school district.
