La orden fue emitida por el juez Vince Chhabria, del Distrito Norte de California, quien detalló que el intercambio de información como nombres, direcciones, números telefónicos y fechas de nacimiento está permitido por la ley.
“La compartición de dichos datos … está claramente autorizada por la ley y las agencias han explicado adecuadamente sus decisiones”, indicó Chhabria en el fallo, pero también concedió una medida cautelar en lo que respecta a cualquier información que vaya más allá de eso.
Chhabria bloqueó el intercambio de datos más amplio, escribiendo que “las nuevas políticas son poco claras sobre qué información se trataría, por qué sería necesaria para fines de control de la inmigración y cuáles serían los riesgos de compartirla con el Departamento de Seguridad Nacional”.
La decisión representa un cambio importante respecto a un fallo anterior del mismo juez en agosto, cuando se ordenó suspender temporalmente la entrega de datos de Medicaid a funcionarios de inmigración tras una demanda presentada por 20 estados, que incluían California, Nueva York y Washington, entre otros.
La política en disputa fue impulsada por el gobierno de Trump, que durante el verano anunció su intención de permitir que el Departamento de Salud y Servicios Humanos (HHS) y los Centros de Servicios de Medicare y Medicaid (CMS) compartan información recolectada en el programa Medicaid con agencias de seguridad, incluido ICE, para ayudar a localizar y procesar a personas que viven en Estados Unidos sin estatus migratorio legal.

(LPL/EN) – A federal judge in California ruled that the Trump administration can share certain basic data of Medicaid beneficiaries with U.S. Immigration and Customs Enforcement (ICE) starting in January, although he imposed clear limits on the type of information that can be shared.
The order was issued by Judge Vince Chhabria of the Northern District of California, who stated that sharing information such as names, addresses, phone numbers, and dates of birth is permitted by law.
“The sharing of such data… is clearly authorized by law, and the agencies have adequately explained their decisions,” Chhabria wrote in the ruling, but he also granted a preliminary injunction regarding any information beyond that.
Chhabria blocked the sharing of broader data, writing that “the new policies are unclear about what information would be involved, why it would be necessary for immigration enforcement purposes, and what the risks would be of sharing it with the Department of Homeland Security.”
The decision represents a significant shift from an earlier ruling by the same judge in August, when he ordered a temporary halt to the sharing of Medicaid data with immigration officials following a lawsuit filed by 20 states, including California, New York, and Washington, among others.
The policy in question was championed by the Trump administration, which announced its intention during the summer to allow the Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services (CMS) to share information collected through the Medicaid program with law enforcement agencies, including ICE, to help locate and prosecute individuals living in the United States without legal immigration status.
