ICE takes custody of Venezuelan man shot by agent after hospital discharge; family still unable to see him

(LPL) – Wilber Rafael Garcés Pérez, the 28-year-old Venezuelan man shot by an Immigration and Customs Enforcement (ICE) agent in Austin, has been discharged from the hospital and placed in the federal agency’s custody, while his family continues to seek information regarding his whereabouts and health status.

Immigration attorney Kate Lincoln-Goldfinch, who represents the family, reported that Garcés Pérez was transferred to ICE custody on Sunday, hours after being taken to the hospital with a gunshot wound to his torso. He had initially been reported to be in serious but stable condition.

According to the attorney, the immigrant’s wife was not directly informed before he was handed over to ICE. The family has also reported difficulties in obtaining information and, so far, has been unable to see him or receive clear details about his location or condition.

«We are very concerned that his family has not been allowed to see him and that we have not received any updates on where he is or how he is doing,» Lincoln-Goldfinch stated.

The situation sparked a protest at the scene of the incident in North Austin. Dozens of people gathered to demand answers and question the actions of the federal agents. The demonstration lasted several hours and ended with a heavy police presence and the use of tear gas and other projectiles to disperse the protesters.

The case also prompted calls for the investigation not to be left solely in the hands of ICE. Austin Mayor Kirk Watson called for the involvement of local authorities and an independent investigation, while Congressman Greg Casar requested transparency and the release of the agents’ body-camera footage.

The Department of Homeland Security (DHS) later announced that its Homeland Security Investigations unit, with support from the FBI, would investigate the shooting. However, questions remain regarding the circumstances that led to the shooting and Garcés Pérez’s current immigration status. Meanwhile, the family’s primary demand remains focused on learning Garcés Pérez’s whereabouts and condition, and gaining access to him, after he was handed over to immigration authorities upon surviving the gunshot.
